Liability Waiver & Terms of Service
Effective Date: January 1, 2026
By booking or using services provided by Sydney Recchia, doing business as (d/b/a) The Notary Desk (“Service Provider,” “we,” or “our”), you agree to the following Terms of Service.
1. Services Provided
The Notary Desk provides Remote Online Notarization (RON) services in accordance with New York State law.
All notarial acts are performed by Sydney Recchia, a commissioned Notary Public in the State of New York.
The Service Provider is not an attorney and does not provide legal advice, document preparation, or guidance regarding the legal effect of any document. You are responsible for confirming the type of notarization required with the requesting party.
2. Eligibility Requirements
To use these services, you must:

Be at least 18 years old

Provide valid, government-issued identification

Have access to a device with camera, audio, and internet

Successfully complete identity verification (including KBA, if applicable)
Failure to meet these requirements will result in refusal of service.
3. Identity Verification
All signers must complete identity verification through an approved platform.
If identity verification cannot be completed, the notarization will not proceed.
You confirm that you are the person you represent yourself to be and that all identification provided is valid and genuine.
4. Client Responsibilities
You agree to:

Provide accurate and complete information

Submit documents that are fully completed but unsigned prior to the session

Be present and attentive during the notarization

Ensure documents will not be altered after notarization
You accept full responsibility for the accuracy, legality, and use of your documents.
5. Remote Online Notarization (RON)
By using our services, you acknowledge and agree that:

The notarization will be conducted via secure audio-video communication

The session will be recorded as required by law
-
Your electronic signature is legally binding, subject to applicable law

Technical issues (internet connection, platform errors, etc.) may require rescheduling
The Service Provider is not responsible for delays or interruptions caused by technical issues outside of their control.
6. Acceptance by Third Parties
You are responsible for confirming that your document will be accepted by the receiving party.
The Service Provider is not liable if a notarized document is rejected by a third party.
7. Refusal of Service
The Service Provider reserves the right to refuse or discontinue services if:

Identity cannot be properly verified

You appear unwilling, confused, or under duress

The document is incomplete, altered, or suspicious

The request violates New York notary law or professional obligations
8. Fees & Payment

Fees are provided at the time of booking

Payment is collected before or during the session

An invoice may be sent via email or text with multiple payment options

Notarized documents will not be released until payment is received in full
All fees are non-refundable once the notarization has been completed, except in cases of Service Provider error.
9. Record Retention & Privacy

The Service Provider may retain session recordings, identification records, and notarial records as required by New York law.

All information is stored using reasonable security measures in accordance with applicable privacy standards.
10. Limitation of Liability
Notarial services are ministerial in nature.
To the fullest extent permitted by law, Sydney Recchia d/b/a The Notary Desk shall not be liable for any indirect, incidental, or consequential damages, including but not limited to document rejection, delays, or third-party refusal.
If liability is determined, total liability shall not exceed the amount paid for the service.
11. Release of Liability
You agree to release and hold harmless Sydney Recchia, d/b/a The Notary Desk, from any claims or damages arising from the use of services, provided services were performed in good faith and in accordance with applicable law.
12. Governing Law
These terms are governed by the laws of the State of New York.
Any disputes shall be handled exclusively in New York courts.
13. Changes to Terms
We reserve the right to update these Terms at any time.
Continued use of services after changes are posted constitutes acceptance of those changes.
14. Entire Agreement
These terms represent the full agreement between you and the Service Provider.
If any part is found unenforceable, the remaining sections remain valid.
